Important message regarding your rights under

the Polybutylene Plumbing Class Action Lawsuits

 
Dear Homeowner:

Thank you for your interest in the DuPont settlement of the nationwide class action of polybutylene plumbing systems in Alabama (Spencer et al v. Shell), which has received final court approval.

DuPont will make its settlement payment in one of two ways:
 



(1) You can apply to the Spencer Class Facility.  This facility has been established to administer the settlement.  Under the terms of the Spencer settlement, DuPont will reimburse you for 10% of the cost of replacing a plumbing system of PB pipe connected with acetal plastic fittings and 10% of any unreimbursed past damages caused by leaks, if you have replaced the system.

 
DuPont will pay under this settlement if you replace your system within 15 years of its installation.  This 15-year limitation period does not apply if you aquired your property after November 1, 1999 and you replace your system by December 31, 2003.   For complete details on the Spencer settlement, please review the Notice of Class Action Settlement.


The systems that are eligible for this recovery are plumbing systems made with PB pipe (which is normally gray) and acetal plastic insert fittings (which are normally gray). (2) There is another program under which you might be eligible for a 100% replacement of your system if it has leaked.  This program is being administered under the direction of a court in Tennessee pursuant to a settlement with Shell Oil Company and Hoechst Celanese Corporation in a PB plumbing class action case known as Cox. A facility called the Consumer Plumbing Recovery Center (CPRC) has been established to administer the Cox settlement. If you have a PB plumbing system, you should contact CPRC at the number shown below to determine if you are eligible for any relief under the Cox Settlement.

If you receive relief from the Shell/Celanese settlement, DuPont will make its 10% Spencer settlement payments directly to the CPRC. You will not receive a separate payment from DuPont under the Spencer settlement in Alabama under this circumstance.

If you purchased your property with polybutylene (PB) pipe and acetal plastic insert fittings after August 1, 1999, the Spencer settlement has a provision that allows you the option to be excluded from the Settlement.  Please review paragraphs 5, 7, and 9 of the Notice for details regarding your rights.
